Max Bulgakov loses bid for separate trial in oppression case

The High Court refused Max Bulgakov’s application for a separate trial on Alexandr Vakiy’s standing in their company oppression case, reported on 16 January 2025.
Vakiy alleges that the affairs of Maxela Limited and EastDeli Limited were conducted oppressively and in disregard of his interests as a member. Bulgakov denies the claim and says Vakiy sold his interests to Corex Emerald Limited; Vakiy disputes that account.
Justice Rory Mulcahy found that the standing issue might not be readily determined apart from the other disputes, including the oppression allegations and the parties’ conduct after the alleged share transfer.
He refused the application, concluding that relevant criteria for a modular trial had not been met, and encouraged the parties to reconsider mediation.
