Mary Tracy won her disability discrimination case over her dismissal by Smurfit Kappa Ireland Limited, trading as the Educational Company of Ireland, the Workplace Relations Commission found.
Tracy worked as an educational sales representative carrying schoolbooks and had systemic lupus erythematosus. Occupational Health restricted her manual handling to 3kg for several months. Her employer offered an alternative role, which she considered unsuitable, before terminating her employment because it said she could not perform the essential duties of her sales role.
The WRC ordered the employer to pay €64,000 in total for failing to consider or explore reasonable accommodations and for discriminatory dismissal. The report says the adjudication officer criticised the absence of a worksite assessment and consultation with Tracy.
