Mario Kirstner was awarded €133,000 by the Workplace Relations Commission for constructive dismissal and unpaid wages, in a decision reported on 30 June 2023. The award comprised €108,000 for constructive dismissal and €25,800 for unlawful wage deductions.
The adjudicator upheld the unfair dismissal claim after finding that the company’s failure to pay Kirstner during his notice period, or its expectation that he work without pay, significantly breached his contract. The decision also found that six weeks of unpaid wages between 1 May and 13 June 2022 amounted to an unlawful deduction.
The company did not appear to defend the case. The report says the dismissal award represented the full six months of lost earnings Kirstner claimed after leaving his €216,000-a-year role.
