Marie Gibson secured removal of the mortgage charge over her home at the High Court, in a decision reported on 28 June 2023.
The court also ordered her daughter, Pauline Gibson, to pay €75,000 exemplary damages for defrauding her parents; solicitor Kevin O’Gorman was ordered to pay Marie €35,000 in damages. The judge found the receiver was not validly appointed and said the Property Registration Authority should correct its register.
On 12 July 2023, the judge directed that two judgments be sent to the Director of Public Prosecutions, which would decide whether to bring criminal charges against Pauline. The court deferred a decision on referrals concerning the solicitor to the Legal Services Regulation Authority, Revenue Commissioners and Law Society.
