A Wicklow man who told gardaí his name was Peter Pan, after being found laying on a footpath, has had his case adjourned for a probation report

John O’Toole (40), of Old Conna Grove, Bray, appeared before a sitting of Bray District Court for sentencing.

He is charged with intoxication in a public place, threatening or abusive behaviour in a public place, obstructing gardaí and one count of refusing to give his name and address.

Sergeant Mick Dee stated that on January 24, gardaí stopped the accused on Killarney Road in Bray while he was lying on a footpath after trying to walk home.

He added that when gardaí asked for his name, O’Toole told them it was “Peter Pan”, before proceeding to tell them to “f*** off”.

The court heard that after gardaí arrested the defendant, he “proceeded to lash out” at them before he was subdued using pepper spray.

It was noted that none of the arresting gardaí sustained any injuries.

Mr O’Toole has 12 previous convictions, all of which are for public order offences.

Solicitor for the accused, Joe Maguire, told the court that his client has been before the court in recent weeks and that Judge David Kennedy had recently ordered a probation report.

Judge Kennedy adjourned the matter until May 21 for the preparation of the probation report.
