Man loses deportation challenge over alleged IS link

Mr Justice Richard Humphreys dismissed all grounds of an unnamed man's High Court challenge to his deportation to Jordan. The proceedings were reported on 24 June 2016.

The man denied the State's claims that he had consulted with senior violent extremist leaders outside Ireland, represented a threat to national security or recruited members for the self-styled Islamic State.

He claimed he had been tortured in Jordan during the 1990s because of his political activities and faced torture if returned. He argued that deportation would breach his rights under Article 3 of the European Convention of Human Rights.

He sought to have the deportation order set aside, to compel the minister to accept his asylum application, and a declaration that he could apply for refugee status under the 1996 Refugee Act without the minister's consent.

The judge said the man had failed to persuade the minister that his account of previous ill-treatment was true or that he faced a real risk of future ill-treatment. He found that the minister had weighed the torture claims and that the man had not shown her decision was unreasonable or her assessment unlawful.

After dismissing the action, the judge adjourned the matter for a week to see whether the judgment would be appealed to the Court of Appeal.
