The Supreme Court allowed appeals by Comcast International Holdings Incorporated, Declan Ganley, Ganley International Limited, GCI Limited, Persona Digital Telephony Limited and Sigma Wireless Networks Limited in proceedings concerning claims against the Minister for Public Enterprise, Michael Lowry, Esat Telecommunications Limited, Denis O’Brien, Ireland and the Attorney General. In a judgment delivered on 17 October 2012, Mr Justice Fennelly agreed with the court’s decision and the reasoning given by the Chief Justice and Justices McKechnie and Clarke. He said he preferred their reasons on the effect of a 21-day letter sent in the Persona case by the Office of the Chief State Solicitor.
