The Supreme Court dismissed an appeal by Mark Nash against the Director of Public Prosecutions, according to a judgment delivered by Mr Justice O’Donnell on 29 January 2015.

Justice O’Donnell said he agreed with his colleagues that the appeal should be dismissed. He also agreed with much of what was said in judgments by Justices Hardiman, Clarke and Charleton, some of which addressed matters of more general application.

He said he could not express concluded agreement with everything in any one of those judgments. He was also not convinced that it would be useful or desirable to give a further view on broader matters that did not need to be decided to resolve the case.

Justice O’Donnell said he would reserve consideration of those issues for a case in which differences of emphasis between the judgments might lead to a different result. The source excerpt does not set out the grounds of appeal or the court’s reasons for dismissing it.
