The High Court has dismissed an appeal by Limerick tenant Jason Cahill against a Residential Tenancies Board determination after finding that the case was brought many months outside the statutory 21-day deadline.

Mr Justice David Barniville, President of the High Court, delivered judgment on July 18, 2025. The ruling dealt with a preliminary objection raised by the RTB and did not determine the substantive complaints Cahill had sought to make about the tenancy tribunal process.

The dispute arose from a tenancy in Limerick. In March 2023, the landlords referred a complaint to the RTB. An adjudicator later found that a January 2023 notice terminating the tenancy was valid and directed Cahill to pay €480 in rent arrears.

Cahill appealed to a tenancy tribunal. The eventual RTB Determination Order, dated February 28, 2024, directed him to pay €1,341 in rent arrears and €1,000 in damages for breach of tenant obligations arising from alleged anti-social behaviour. It also upheld the notice of termination, found that he had been overholding since February 13, 2023 and directed him to vacate the property.

The order and tribunal report were issued on March 5, 2024 and received by Cahill on March 7. He was expressly told that any appeal on a point of law had to be brought to the High Court within 21 days.

Cahill initially indicated by email that he did not intend to bring a High Court appeal. He later changed course. His appeal was ultimately filed on December 20, 2024, more than nine months after he received the RTB material.

The court held that section 123 of the Residential Tenancies Act 2004 imposes an absolute 21-day appeal period which the High Court cannot extend. That conclusion followed a consistent line of earlier decisions and Supreme Court observations supporting the same interpretation.

Mr Justice Barniville added that even if an extension had been legally possible, Cahill had not shown a timely intention to appeal, an adequate explanation for the delay or an arguable ground of appeal. The appeal was therefore dismissed.
