Reasons reported in the judgment

The Court of Appeal reduced Ibrahim Lawel’s sentence for his role in receiving a cocaine parcel from 10 years’ imprisonment to six years, with the final 18 months suspended. It found an error in principle because the original sentence did not give sufficient weight to the mitigating circumstances accepted by the sentencing judge.

Lawel had pleaded guilty to an offence under section 15A of the Misuse of Drugs Act 1977, as amended, arising from a controlled delivery in May 2011. The parcel, which contained cocaine valued at €1.4 million, was delivered to his home in County Kildare under a false name. Lawel signed for it and left it by an external door. The judgment records that he then drove to collect a co-accused, who took the parcel.

The prosecution accepted that Lawel did not know the parcel contained drugs, but was reckless as to its contents. The court heard that he had no role in arranging the operation or distributing the drugs, had no ownership or share of the profits, and received €20 towards diesel. A prosecuting detective accepted there was an imbalance of power in Lawel’s relationship with the person who asked him to receive the parcel. The detective also said Lawel had cooperated substantially and was unlikely to come to Garda attention again.

Lawel was originally sentenced at Naas Circuit Criminal Court in March 2016 to 10 years, with the final three years suspended. The Court of Appeal noted that this was the same headline sentence imposed on two co-accused described as the operation’s masterminds, although they received no suspended portion. It said each offender had to be considered on their own circumstances.

The appeal court concluded that the three-year suspension represented a 30% reduction, while a guilty plea alone would justify a reduction of about 25% in similar cases. It considered the remaining allowance inadequate given the other mitigating factors, including Lawel’s limited role, lack of previous convictions, cooperation and rehabilitation efforts. It quashed the original sentence and resentenced him to six years, suspending the final 18 months on the same conditions imposed below. The court directed that he receive credit for almost nine months spent on remand between 26 October 2011 and 19 July 2012.
