The High Court has ruled that Sky Ireland must tell customers when their minimum contractual commitment periods are ending and provide them with information about the best tariffs available.
ComReg brought the case after Sky declined to provide Irish customers with end-of-contract notifications, best-tariff advice and annual best-tariff information required under electronic communications regulations.
Sky argued that the requirement did not apply because its customer agreements are described as contracts of “indeterminate duration”. Although customers normally commit for a minimum period of 12 or 18 months, Sky said the contract itself continues indefinitely until cancelled and therefore is not a fixed-duration contract which is automatically prolonged.
Ms Justice Eileen Roberts rejected that interpretation. She found that the legal effect of Sky's arrangements was what mattered, rather than the label placed on them.
Customers are tied to Sky for a defined minimum period and may face early termination charges if they leave during that time. Once the minimum period expires, they can cancel on 31 days' notice without that penalty, while the contract otherwise continues automatically.
The court held that this brought Sky's agreements within Regulation 89(6) of the European Union (Electronic Communications Code) Regulations 2022 and the corresponding EU rules. In ordinary terms, the judge found that the end of the minimum commitment period is the point at which a customer's contractual lock-in ends, even though the wider subscription continues.
The judgment said allowing providers to avoid the consumer-protection rules simply by describing contracts as indefinite would undermine the purpose of the legislation. That purpose includes enabling customers to make informed decisions about switching provider or moving to a better tariff once they are free to leave without an early termination charge.
The court declined to refer the interpretation issue to the Court of Justice of the European Union, finding that it could decide the matter using established principles of EU law.
ComReg's application was granted. Sky must provide the required information when customers' minimum commitment periods expire and best-tariff information annually thereafter. Final orders, including costs, were listed for January 21st, 2026.
