The court refused a further adjournment after Lawless did not appear on 28 March 2025. A certificate showed that he had attended Tallaght University Hospital’s emergency department the previous evening. The judge considered the certificate inconclusive, alongside the history of the case, and decided not to adjourn again.

The court ordered summary judgment for €276,500 and remitted the rest of the claim to a plenary hearing. It proposed a timetable for pleadings on that remaining claim. Lawless’s separate motion for inspection of original documents was struck out because he did not attend to move it. The parties were given three weeks to submit written views on final orders and costs, and the case was listed for mention on 14 May 2025. The judgment did not make a final costs order.

Why

Reasons reported in the judgment

In a judgment delivered on 10 April 2025, Mr Justice Barr said the evidence established that Lawless accepted a €280,000 loan facility from ACC Bank in 2010, repayable on demand. The court accepted that the loan was transferred first to Rabo UA and then to Cabot, and that Lawless was notified of the transfers. It was satisfied that the account evidence established the principal sum claimed.

The High Court has granted Cabot Financial (Ireland) Limited summary judgment for €276,500 against Brendan Lawless, representing the principal on a loan. The court sent the remaining part of the claim, including disputed surcharge interest, to a plenary hearing, where it is to be determined through further proceedings.

Cabot had originally sought €499,477.48, including principal and interest. It agreed that its claim for surcharge interest, which Lawless challenged as a penalty, could be heard at a plenary hearing. The summary judgment application was limited to €276,500 in principal. The judge said the interest issue was not decided on this application.

Lawless raised several proposed defences, including that the loan transfers had not been adequately proved, that the claim was out of time, that sale proceeds from secured properties had not reduced the loan balance, and that Cabot lacked authority to enforce the agreement. The court rejected those arguments for the purpose of the summary judgment application. It found the transfer evidence sufficient, held that the limitation period began when payment was demanded in writing, and said the property-sale proceeds had reduced another debt owed by Lawless. It also rejected the argument about Cabot’s authority to enforce.
