The High Court has decided that an order for security for costs sought by Bandan Properties Limited should be made in its case against Fanplex Limited.

In a decision delivered on 28 July 2022, Mr Justice Brian O’Moore said he had considered the evidence, written submissions and oral submissions before deciding against the plaintiff on the security motion.

The judgment does not set out the amount or terms of the proposed security order. At the end of the motion hearing, counsel for Fanplex sought to reserve the plaintiff’s position on the correct form of the order in the event the court ruled against it.

The court listed the matter for 10am on 28 September 2022 to deal with any issues properly arising in relation to the proposed order. The decision therefore records the court’s ruling that security for costs should be ordered, while leaving the order’s terms to be addressed at the later listing.
