The High Court sitting in Cork has refused to stop Everyday Finance DAC from proceeding with enforcement over two Waterford properties secured against a €600,000 loan taken out more than 20 years ago.
In an ex tempore judgment delivered on 5 March 2026, Mr Justice Peter Charleton rejected Dolores Corcoran’s application for an interlocutory injunction concerning 6 Henrietta Street and Portnahully, Carrigeen, Waterford.
The loan originated in December 2005 with EBS Building Society and was made to Dolores Corcoran and her father, Michael Corcoran, who has since died. The facilities were secured against several properties. The judge said the loan had not been repaid and had substantially increased through interest over time.
Corcoran challenged Everyday Finance’s entitlement to enforce the debt on several grounds. She argued that redactions in the 2019 loan-sale documents meant the transfer to Everyday Finance had not been proved.
The court disagreed, finding that the deed clearly identified Everyday Finance as purchaser, referred specifically to the Corcoran loans and guarantees, and had been followed by notices informing Corcoran of the transfer.
She also argued that the original loan arrangements may have failed because a condition concerning legal advice on use of the family home as security had not been satisfied. The court found there was no evidence that solicitor Gerald Kean had failed to provide or confirm the required advice. It also held that such a condition was for the lender’s benefit and could in any event be waived.
A further argument that Everyday Finance should only recover an equitable amount because it may have purchased the debt at a discount was rejected. The judge said there was no legal authority supporting such a proposition.
The court also rejected an attempt to link any potential claim against Kean to the debt enforcement.
Finding no fair case to be tried, the judge refused the injunction. Everyday Finance was awarded its costs of the failed motion, while no costs order was made in respect of the other financial institution represented at the hearing.
