The Court of Appeal has upheld an effective four-and-a-half-year prison sentence imposed on MM for sexual assault and possession of child abuse material.
In a judgment delivered on 16 March 2026, the court dismissed MM’s challenge to the seven-year headline sentence selected for the sexual assault offence.
MM had pleaded guilty on 30 July 2024 to one count of sexual assault and one count of possession of child pornography. The victim was 19 and MM was 26 when the sexual assault occurred on 19 June 2021.
The court heard that the victim became unwell while socialising with friends and went to sleep in a bedroom. During the night, MM entered the room and subjected her to a series of sexual assaults while she was in a vulnerable condition. She reported what happened to Gardaí the following day.
A search of MM’s home on 23 June 2021 led Gardaí to seize two phones. Examination of the devices uncovered six videos and 20 images of child abuse material which the judgment said had been purchased and stored on the phone.
On 29 November 2024, the sentencing court set a seven-year headline sentence for the sexual assault, reduced it to five years for mitigation, and suspended the final six months. A consecutive 12-month sentence for possession of child pornography was suspended in full. The resulting effective custodial term was four-and-a-half years, backdated to 21 November 2024.
On appeal, MM argued that the sexual assault should have been placed in the mid-range rather than the upper range of seriousness because it arose from a single incident and was not pre-planned.
The Court of Appeal rejected that argument. It said the offending involved several serious violations over a period of time against a vulnerable young woman known to MM, together with a significant breach of trust and profound consequences for the victim.
The court found no error of principle in the seven-year headline sentence and dismissed the appeal. The mitigation reduction itself was not challenged.
