The High Court declared that Pat Malone’s 2011 proceedings against Catherine Allison, as they stood, were bound to fail. It did not dismiss the case at that stage, instead adjourning it for further submissions, including on an undertaking concerning the proceeds from a land sale.
In a judgment delivered on 27 February 2012, Miss Justice Laffoy considered Allison’s application to strike out or dismiss the claim. Malone had sought declarations that a 2006 charge and a 2009 settlement were invalid, alongside damages for misrepresentation. The court said the 2009 settlement and related consent order prevented him from reopening the validity of the charge, and found nothing in his claim that provided a stateable basis to set aside the settlement.
The dispute arose from a €160,000 loan and security over land in County Louth. In earlier proceedings, the parties had agreed to sell lands registered on Folios 11743 and 3583. Under their January 2009 settlement, Allison was to receive €230,000 plus statutory interest from the sale proceeds, after specified sale costs, in full and final settlement of their issues. The settlement was recorded in a consent order.
Malone’s handwritten statement alleged, among other things, that he had not received title to a bungalow he intended to buy, and that Allison had acted fraudulently and pursued an unlawful loan. The judge said the document did not comply with court rules and did not set out facts substantiating the fraud allegations. Malone did not file a replying affidavit. Allison said she did not know whether he had received title to the bungalow, and argued that the settlement resolved the parties’ disputes.
Laffoy J. said the material before her did not show a circumstance that would permit the settled issues to be relitigated or a legal basis to set aside the consent order. She noted that her consideration had gone beyond the pleadings in aid of Malone, who was unrepresented.
The court did not make an order dismissing the 2011 proceedings. The judge identified unfinished matters, particularly Allison’s undertaking, recorded in a July 2011 order, to hold net sale proceeds exceeding €160,000 pending further order. She adjourned the matter for further submissions. The judgment does not determine the underlying allegations or record a final dismissal of the proceedings.
