The High Court quashed a Refugee Appeals Tribunal decision on an asylum claim after finding the applicant had not been given an opportunity to address the Tribunal’s decision to assess her case on the basis that she was South African.
Mr Justice McGovern delivered the judgment on 28 June 2007. He remitted the appeal to the Tribunal for a rehearing, quashed the Minister’s refusal to grant the applicant refugee status and restrained the Minister from making a deportation order while the rehearing remains pending.
The applicant arrived in Ireland on 29 March 2005 and sought asylum. She presented as South African but later stated in her asylum questionnaire that she was from Zimbabwe and had been born in Bulawayo. She claimed she feared persecution in Zimbabwe because of her opposition to the Mugabe regime, and also feared arrest, detention, torture and violence if returned there after her asylum claim failed.
A Refugee Applications Commissioner accepted that she was from Zimbabwe but rejected her claim on credibility grounds. The Tribunal appeal proceeded without an oral hearing. The Tribunal member treated the applicant as South African, found there was insufficient evidence to establish Zimbabwean nationality, and said her claims about persecution in Zimbabwe were irrelevant to the assessment. The appeal was rejected.
The High Court said the applicant had appealed on the basis that the Commissioner had accepted her Zimbabwean nationality. She therefore had no reason to expect she would need to reopen that issue in the appeal. The judge said the Tribunal could revisit nationality, but fairness required it to notify her and give her an opportunity to make arguments. The judgment said the Tribunal had not sought further inquiries from the Commissioner under section 16(6) of the Refugee Act 1996.
The court’s ruling concerned the fairness of the Tribunal’s procedure. It did not decide the applicant’s nationality or whether she qualified for refugee status. The Tribunal must reconsider the appeal at a rehearing, and the restraint on deportation applies pending that outcome.
