A man identified in the judgment as C.F. was sentenced to concurrent prison terms after a jury convicted him of five offences involving two complainants, the Central Criminal Court heard.
The jury returned its verdicts on 22 July 2011. The convictions were for rape, oral rape, attempted rape and false imprisonment involving B.K., and sexual assault involving C.M. The judgment does not state C.F.’s full name.
The offences occurred in the early hours of 16 September 2007. The court’s account said C.M. accepted a lift after an evening out and later woke in the accused’s car in a field. He was kissing her, she had his penis in her hand and he was touching her vagina. She told him to stop, and he did. He later gave her telephone number to gardaí, who contacted her while investigating the offences against B.K.
The judgment said C.F. picked up B.K. after leaving C.M. Rather than taking her home, he stopped in a country lane and prevented her from leaving. After a struggle, he drove on and stopped again with the passenger door against a brick wall. The court’s account said he raped her, made her perform oral sex out of fear, and attempted anal sex. B.K. suffered bruising to her face, breasts, chest, arms and legs.
In setting sentence, the judge treated B.K.’s injuries and detention in the car as aggravating factors. Mitigation included C.F.’s remorse and apology, personal circumstances, engagement with rehabilitation and counselling, cooperation with gardaí, and the absence of relevant previous convictions. The judgment also noted courses completed in prison and material about his childhood and sexual abuse.
The court imposed six years for each of the rape and oral rape convictions, four years for attempted rape, four years for false imprisonment, and 18 months for sexual assault. It ordered all terms to run concurrently and backdated them to the time C.F. entered custody following his 22 July 2011 conviction. The court declined to impose post-release supervision.
