Lisa Dalton wins unfair dismissal case over alleged underperformance

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

Lisa Dalton won her unfair dismissal case against Donegal County Council, with the Workplace Relations Commission ordering €10,000 compensation. The proceedings were reported on 23 March 2023.

Adjudicator Emilie Daly found that the council’s evidence contradicting Dalton about the ring-buoy inspections relied on hearsay from her absent line manager. She said she could not find that Dalton’s conduct contributed to her dismissal.

Dalton had been dismissed in November 2021 after allegations of underperformance relating to safety inspections.

Dalton sought more than €30,000 in lost earnings, but Daly found she had failed to meet her obligation to mitigate her losses. Daly said nine job applications in 2022 were not adequate, noting Dalton’s argument that she was seeking work suited to her family and career.
