Larry McCarthy refused bail over threat to kill charge

By Eimear Byrne

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

Larry McCarthy was refused bail at Limerick District Court on 5 August 2015. He was charged with threatening to kill or cause serious harm to Noel Moore at Mr Moore’s home, Windsor House, Donoghmore, County Limerick, on 28 July 2015. Judge John King remanded him in custody to the same court on 19 August 2015, saying he was not satisfied there had been a significant change in circumstances.

Solicitor Ted McCarthy said he was renewing the bail application because of significant changes in circumstances. He said Mr Moore had gone to Roxboro Rd Garda Station and said he did not wish to proceed with his complaint and was not in fear. The solicitor said Judge Marian O’Leary’s earlier refusal of bail had been based solely on garda claims that Mr Moore feared for his life.

Judge John King said Mr Moore had plainly made a complaint, as it had resulted in charges. Sgt John Moloney said he was unaware of Mr Moore visiting the station that day. After an adjournment, he told the court the case was continuing and a file was being prepared for the Director of Public Prosecutions.

Solicitor Ted McCarthy said he would shortly bring a High Court application. The proceedings were reported on 6 August 2015.

This report covers an earlier stage of the case. Later developments are not reported here.
