KOD Lyons settles High Court contract dispute

By Fionn Kelly

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

Two disputes involving KOD Lyons had been resolved, the High Court was told on 20 January 2017. Frank Callanan SC, for Michael Kelleher, told Mr Justice Tony O’Connor that the parties in the partnership case had resolved their differences after significant talks and that the case could be struck out.

Michael Kelleher had sued fellow solicitors and partners John O’Doherty and Aine Flynn, claiming he had been frozen out of the practice. The claims were denied. Marcus Dowling BL, for Aine Flynn and John O’Doherty, said Michael Kelleher would leave KOD Lyons and establish his own practice. The firm would continue practising, and Mr Dowling said its clients had not been affected. No other details of the partnership settlement were revealed.

Mr Dowling also told the court that KOD Lyons’ alleged breach-of-contract action against former solicitors Freda Murphy and Niamh O’Brien had settled. The firm had sought injunctions restraining them from canvassing its clients or practising within a mile of its offices until April 2017. Both the injunctions and the breach-of-contract claim were fully contested. No terms of that agreement were outlined. The action against Freda Murphy and Niamh O’Brien was adjourned to allow the settlement to be implemented.
