Kieran Wallace’s appeal over the Protim Abrasives pension shortfall was upheld by the Workplace Relations Commission, with liability set at €2.84 million in a decision published on 9 December 2024.

The dispute concerned the pension scheme of Dublin-based Protim Abrasives Ltd, which went into liquidation in November 2009. Wallace had challenged the Department of Enterprise, Trade and Employment’s refusal to pay more than €6 million into the scheme.

Adjudicating officer Penelope McGrath calculated the liability using a €3.7 million funding need identified by the scheme’s actuary in September 2009, less €876,000 from asset sales paid to trustees in 2015.
