Kevin Foley awarded nearly €170,000 for unfair dismissal

Kevin Foley was awarded nearly €170,000 after the Workplace Relations Commission found his dismissal unfair, despite a genuine redundancy, reported on 4 October 2024.

Foley had worked as Digital River Ireland’s Senior Director of Sales for EMEA from 31 May 2021 until his dismissal on 19 October 2022.

The adjudicator found a serious flaw in the employer’s appeal process: Foley was not given a hearing or the opportunity to be accompanied.

The company’s US-based General Legal Counsel handled the appeal, although the employee handbook said appeals would be heard by a more senior manager.
