A man who claimed he broke into his ex-partner’s flat to take his pet dog has appeared before Tralee District Court.

David Walsh (30) of Cois Coille, Killeen Road, Tralee was charged with burglary for breaking into a flat on Upper Rock Street, Tralee and taking a pet dog and fireworks.

The State objected to bail based on the seriousness of the offence.

The court heard Mr Walsh and the woman had been in an unstable relationship for years.

“Gardaí have serious concerns he’ll seek to contact the injured party,” said Sergeant Detective Chris Manton.

Solicitor Padraig O’Connell argued his client had lived at the address and noted the property agreement was in the name of both the accused and his former partner.

“The victim said he had moved,” said Sgt Det Manton.

The defendant shook his head and the judge advised him to keep quiet.

“He has lived there but gardaí believe he moved out of the address two weeks ago,” said Sgt Det Manton.

He noted that the defendant had allegedly kicked in the door and had no key.

Ownership of the dog was disputed. Ownership of the fireworks was not.

“This is not your typical burglary case,” said Judge Waters. “It is a case where he is one of the tenants.”

Sgt Det Manton said the woman had been strongly encouraged to get a protection order.

Mr Walsh was granted bail at €300 and is to appear before Tralee District Court on October 22.
