Judge says he has cut-off limit in drugs cases as Offaly man charged

By Offaly Live Court Reporter, Midland/Tullamore Tribune (OffalyLive.ie)

JUDGE Andrew Cody has said he does not normally retain alleged drugs charges in the District Court if the value of the suspected substances exceeds €5,000.

Judge Cody was speaking at Tullamore District Court when Tyler Donoghue (22), 32 Chancery Close, Tullamore appeared before him accused of possessing cannabis for sale or supply to others at that address on February 17 last.

Mr Donoghue is also accused of a similar offence at Meadow Close, Tullamore on the same date.

Further charges alleged possession of cannabis and Sergeant Brendan Kearns said the DPP had directed the matters could be disposed of summarily, meaning they would stay in the District Court instead of being sent forward to the higher Circuit Court.

Sergeant Kearns said the alleged value of the drugs was €6,647.

Judge Cody said he would remand Mr Donoghue on continuing bail to a later date to consider jurisdiction.

The judge added that €5,000 was his “cut-off limit” for alleged drugs as a rule of thumb.

He remanded Mr Donoghue to appear in court again on Wednesday, October 7.
