Judge approves €40,000 settlement for girl injured in Wicklow Lidl fall
The Wicklow PeopleA Wicklow judge has approved a €40,000 settlement for a young girl who fractured her shoulder after slipping and falling in a Lidl store in Greystones.
An infant settlement application was brought before a sitting of Wicklow Circuit Civil Court by the girl, who was suing through her father, in a case against Lidl.
Counsel for the youth, Damian Sheridan, informed the court that in September 2023, his client, who was 11 at the time, had a “slip and fall” in a Lidl store in Greystones, with the Personal Injuries Assessment Board assessing the claim at €40,000.
She suffered a fracture to her shoulder and was placed in a sling for three months, with doctors diagnosing a closed fracture of her humerus.
It was noted that the youth was also seen by multiple specialists.
After the youth’s parents received the offer from the Personal Injuries Assessment Board, they sought legal advice.
Mr Sheridan told the court that he advised that the offer was at the lower end of the appropriate range, as the Personal Injuries Guidelines provide for awards of up to €75,000.
The court heard that shoulder injuries can cause permanent restriction, but generally have a “speedy recovery”.
Judge John Martin approved the settlement and directed that the money be lodged in an account within 21 days until the girl reaches the age of 18.
However, he also awarded costs of €3,000 to the youth’s legal team.
