Joshua Wilson asked the High Court for an order restraining about 10 people from trespassing at Marlfield House, near Clonmel, as he claimed they were obstructing renovation work. The matter came before Mr Justice Mark Sanfey on 19 December 2023.
The court heard that several defendants had claimed in correspondence that they had valid tenancies. Wilson disputed this, saying they had no valid or legal entitlement to reside on the property.
Wilson claimed that he bought the property from receivers in October 2023 and could not access parts he wanted to restore. He said a section of the house’s ceiling had recently collapsed, creating a risk that repairs were needed urgently.
The judge, on an ex parte basis, permitted Wilson to serve short notice of the injunction proceedings on the defendants. The case was adjourned to January, with permission to return sooner if necessary.
