Jonathon Joyce’s unfair dismissal complaint rejected by WRC

By Cathal Brosnan

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

Jonathon Joyce’s unfair dismissal complaint was dismissed by the Workplace Relations Commission in a decision dated 26 January 2024. Adjudicator Janet Hughes found that a break in service left him below the 12 months of continuous service normally required to pursue the claim under the Unfair Dismissals Act.

The adjudicator concluded that the HSE was responsible for his dismissal, but dismissed the complaint without considering whether the dismissal itself was fair. She also criticised the informality of the HSE’s agency employment arrangements. The HSE told the WRC that there were no guidelines for managers completing references for former employees.
