John Delaney was refused leave to appeal the ruling on legal privilege over seized documents at the Supreme Court, reported on 2 February 2024.

The court declined to hear a further appeal from the Court of Appeal’s 2023 decision, which had upheld the High Court’s rejection of his privilege claim over 1,123 documents seized by the Corporate Enforcement Authority in 2020 during its investigation into the affairs of the Football Association of Ireland.

The Supreme Court concluded that the privilege issues were not unusual in civil proceedings and that the case did not raise an issue of general public importance warranting another appeal.

It said the proposed appeal would revisit arguments already fully considered by the High Court and Court of Appeal.
