John Delaney’s bid to appeal the ruling on access to seized documents was dismissed by the Supreme Court, reported on 26 January 2024.
The Supreme Court said a further hearing was not in the interests of justice, after the Court of Appeal had upheld the finding that the documents could be accessed by the Corporate Enforcement Agency (CEA) in its investigation into the FAI. Delaney had claimed that just over 1,100 documents relating to him were protected by legal professional privilege.
