John Callaghan lost his challenge to keep a stay in place over a windfarm’s strategic infrastructure designation in the High Court on 15 May 2017.
Ms Justice Costello held that no stay remained and that An Bord Pleanála was free to decide the Castletownmoor windfarm application after the Court of Appeal delivered its decision.
The court said the application to vary or discharge the stay was not the final decision in the judicial review proceedings, and retained jurisdiction to consider the issues on their merits.
