A Commercial Court case brought by Hears Technology against BAK Holdings and Brendan Morrissey was struck out after the court was told the dispute had been resolved. Mr Justice Denis McDonald gave liberty to apply again if necessary.
On 23 June 2023, Eoghan Cole BL, for Hears, said a settlement had been reached that week and related proceedings had also been resolved. Padraig Lyons SC, for BAK, said his client consented to the application.
Hears had alleged that Mr Morrissey defrauded it of just over €1 million paid to BAK for software development services. BAK denied the claims, and Mr Morrissey said all the payments were legitimate.
Separately, BAK brought proceedings against Hears alleging shareholder oppression. In that action, Mr Morrissey claimed John Bishop’s actions had damaged Hears. Mr Bishop strongly denied the claims.
