Jerry Beades challenge to judge appointment dismissed

By Rory Hanlon

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

Jerry Beades had his High Court challenge to Peter Kelly’s appointment dismissed on 3 June 2016. The case concerned whether Kelly was suitable to become President of the High Court.

The High Court found that the proceedings disclosed no reasonable cause of action and dismissed them under the Rules of the Superior Courts or its inherent jurisdiction. Beades had sought declarations that Kelly was unsuitable and orders concerning the appointment process.

The court also found that the proceedings amounted to an abuse of process. A separate application by Beades for judgment in default of defence was deferred pending the decision on the defendants’ dismissal application.
