Irish Coursing Club injunction refused by High Court

The Irish Coursing Club had its injunction application refused by the High Court on 25 January 2021. The application sought permission for coursing to resume during Covid-19 restrictions. Ms Justice Niamh Hyland found the court had no jurisdiction to direct the Minister for Health to legislate in prescribed terms, and said the balance of convenience and risk of injustice also weighed against granting the order.
The club had applied for an interlocutory injunction pending determination of its judicial review proceedings. The judgment said at least some of the club’s grounds of challenge were sufficiently strong to meet the relevant test, but relief was refused.
A later High Court case excerpt dated 5 March 2021 says the parties made submissions on the costs of the injunction application. It partially records a request made by the club, but does not give the costs decision.
