Indian woman loses appeal over marriage of convenience residency

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

The Court of Appeal dismissed an Indian woman’s appeal over the refusal of residency linked to a marriage of convenience, in a decision reported on 13 December 2023.

The court found no error of law in the Minister for Justice’s decision or the High Court judgment, and agreed that no oral hearing was required before the residency renewal was refused.

The woman had told immigration officers in a 2018 interview that she and the EU national had never lived together and had married because she needed a visa. Her lawyers later denied that the marriage was based on obtaining permission to remain in Ireland.

The appeal followed a High Court dismissal in 2022. The Court of Appeal said the couple had been given a meaningful opportunity to provide information in response to concerns about the marriage.
