High Court sets December hearing in father’s case over daughter’s return from Poland

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

The High Court set a December hearing, expected to last one day, in an Irish father’s case seeking State action to help return his daughter from Poland. The man, whose identity is withheld to protect the child, told the court he had been without her for 626 days.

The father said he had made 11 attempts in Poland to locate his daughter. He told Mr Justice Garrett Simons that he possessed documents from the Department of Foreign Affairs and Polish authorities which the Irish State had claimed it was not aware of.

The November report said that at an October hearing the court refused a State motion to strike out the case. The father said he no longer wished to take part, but the judge gave him two weeks to reconsider. The State’s lawyers argued that executing the Polish return order was a matter for Polish authorities.
