John Waters and Gemma O'Doherty’s application for permission to challenge Covid-19 laws was due to be heard in the High Court on 5 May 2020.
When the action was mentioned on 28 April, Mr Justice Charles Meenan declined to grant leave at that stage. He said the applicants had to prove at the following week’s hearing that the threshold for permission had been crossed.
The State opposed the application, saying the claims were not arguable. The judicial review proceedings sought to have legislation and temporary Covid-19 restriction regulations quashed.
