High Court extends injunction over alleged trespass at Leitrim housing scheme

The High Court extended an injunction concerning part of the Shannonside View Traveller Group Housing Scheme in Carrick-on-Shannon, Co Leitrim, on 8 July 2022. Mr Justice Conor Dignam said it would remain in place until the final hearing of the action.

Niall Flynn BL, for Leitrim County Council, told the court that the defendants had vacated the site. He said the council was concerned that others might try to occupy the derelict bay, which had been closed off from the rest of the scheme.

The council had secured an earlier injunction against John Mongan, John Mongan Junior and Margaret Mongan, whom it alleged were among the people on the site. It said caravans had been parked in the bay without permission and the occupants had initially refused to leave.

On 22 June 2022, Mr Justice Brian O’Moore made orders on an ex-parte basis against the three named individuals and other persons wrongfully occupying the site. The orders restrained interference with the council taking possession and entry or placement of further structures on the land without its consent.

Mr Flynn said there were serious safety concerns about the bay’s sewage and electricity supply. The council planned to repair and renovate the site and make the bay available for use, but he said the work would not be done in the short term.

The defendants were not in court on 8 July. On a previous occasion, Mrs Mongan told the court that they were seeking legal advice.
