The High Court has dismissed F.A.Y. (NIGERIA)’s challenge to the refusal of access to a scheme for long-term undocumented residents. Ms Justice Nessa Cahill delivered judgment on 25 February 2026.
The Court held that temporary permissions granted while his residence-card review was pending were discretionary, remained valid until expiry and meant he was not undocumented throughout the required period. It rejected his alternative argument concerning EU-law residence rights and dismissed the claim.
The judge was provisionally of the view that the Minister should receive the costs. Written submissions were due by 13 March 2026, with the matter listed for 18 March 2026 for costs and final orders. The proceedings were reported on 28 February 2026.
