Eleven Guinness delivery workers won unfair dismissal awards from the Workplace Relations Commission, reported on 5 May 2023. The WRC found that their keg swaps did not amount to gross misconduct and that dismissal was disproportionate.
The workers had been dismissed after their employer accused them of gross misconduct over deliveries to a Dublin pub. Awards for the 11 who attended hearings ranged from €2,320 to €21,000 each.
Separate orders for colleague Sean Corcoran included €5,200 for unfair dismissal and €2,720 in notice pay. The unfair dismissal awards across the 12 cases totalled €114,240, in addition to the notice pay.
