Graziano D'amato awarded €42,000 for unfair dismissal

Graziano D'amato won his unfair dismissal complaint against Tripadmit Ltd at the Workplace Relations Commission on 10 October 2024.

The WRC directed the company to pay him €42,000 after finding his dismissal unfair under the Unfair Dismissals Acts.

The adjudication hearing took place on 14 February 2024. D'amato had worked as a sales and account executive for the travel technology start-up.

The WRC found the company had not clearly established whether it dismissed him over business conditions or his performance.

It also found the company had followed neither a redundancy process nor a performance improvement or disciplinary process.

The adjudicator concluded that the company contributed to D'amato’s continuing financial loss by refusing to provide a written reference.

The award took account of the company’s business pressures and the adjudicator’s view that the ongoing loss was unlikely to reach two years.
