Graham Dwyer’s challenge to data retention law continued in the High Court on 6 March 2018.
Professor Michael Clarke told the court that broad retention regimes were necessary to detect serious crime and terrorism. Dwyer argues the 2011 Act breached his privacy rights by allowing data from his mobile phone to be used during his murder trial.
Clarke said targeted alternatives would be impractical, while accepting that accessing retained data raised privacy issues. The hearing continued.
