The Sligo ChampionA girl who had glass fall on to her head after her father’s stationary car was rear-ended by a motorcyclist has been awarded damages of €30,000.
An infant settlement application was brought before a sitting of Sligo Circuit Civil Court by the minor, suing via her mother, in a case against Jorge Fernandez.
Mr Keith O’Grady BL, instructed by Damien Tansey solicitors, told Judge Deirdre Browne that on April 5, 2025, the minor was a rear passenger in a car driven by her father.
The car was stationary at Rosses Point, when Mr Fernandez, who was driving a motorcycle, rear-ended the car. The collision shattered the rear window and sent the glass onto the child’s head.
The respondent’s insurance company had offered the sum of €30,000. The girl suffered neck and back pain and persistent headaches and missed one week of school.
Mr O’Grady said that she had an examination five days post accident which found that she suffered from intermittent neck pain. He continued that five weeks post accident, she visited a doctor, whose report showed that she had lower back pain.
Seven weeks post accident, an MRI scan was carried out on the child which detected no abnormalities.
Judge Browne said she had no hesitation in approving the settlement.
