Frank Agrama loses appeal over evidence in Italian fraud case

By Donal Gilhooly

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

Frank Agrama lost his Court of Appeal challenge to evidence-gathering for an Italian fraud investigation on 22 February 2016. The court dismissed his appeal against a refusal to grant leave for judicial review of the Minister for Justice’s nomination of a District Court judge to receive the evidence.

The judgment said Agrama’s argument wrongly treated criminal investigation and proceedings as mutually exclusive. It found no evidence that the investigation had ended or that receiving the material fell outside its scope. Agrama had been acquitted in Italy in 2014 on charges including aggravated misappropriation and tax fraud, but that earlier outcome was not the issue decided in this appeal.
