FAI wins legal privilege ruling over ODCE documents

The FAI secured a High Court ruling that parts of documents provided to the ODCE were legally privileged. The proceedings were reported on 30 July 2019. The ruling concerned extracts from 16 documents supplied by the FAI and Deloitte Ireland LLP during an investigation into certain matters concerning the association.
Ms Justice Leonie Reynolds found that 14 passages contained privileged material and ordered them redacted so the ODCE could not use them in its investigation. Parts of two other documents did not attract privilege, including material from an FAI Domestic Committee meeting and a board-management meeting that did not disclose legal advice. The court made no order on legal costs.
