FAI privilege claim adjourned over legal advice documents

By Rory Hanlon

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

The High Court adjourned the FAI’s legal privilege claim over advice documents, reported on 15 May 2019. The claim concerns material given to the Office of the Director of Corporate Enforcement.

Ms Justice Leonie Reynolds received the documents on 9 May 2019 and is considering whether information in 10 documents is legally privileged. The FAI says the material includes advice from interim chief executive Rea Walshe, while the ODCE disputes whether she acted as the association’s internal legal adviser at the relevant meetings.

The judge adjourned the matter to allow further submissions, including on whether ODCE lawyers should inspect the documents.
