The FAI’s legal privilege claim over documents was adjourned in the High Court, as reported on 15 May 2019. The case concerns 10 documents given to the Office of the Director of Corporate Enforcement, including board minutes and legal advice received from interim chief executive Rea Walshe.
The FAI says limited passages are privileged, while the ODCE questions whether Ms Walshe was acting as the association’s internal legal adviser when some advice was given. Ms Justice Leonie Reynolds is to determine the claim, which arises from an investigation under the 2014 Companies Act.
This report covers an earlier stage of the case. Later developments are not reported here.
