Enoch Burke loses High Court challenge to school order
This report is a localnews.ie summary based on public court reporting and records; sources are listed below.
Enoch Burke lost his High Court action to set aside the order requiring him to stay away from Wilson’s Hospital School, in a judgment reported on 19 July 2024.
Mr Justice Mark Sanfey ruled that the court lacked jurisdiction to entertain the application, which fell far short of the exceptional circumstances required to reopen a final order. He dismissed the action and said the school was entitled to its costs, with written submissions to follow before finalising the costs orders.
The May 2023 order remains valid and restrains Burke from entering or trespassing at the school. The judgment said his imprisonment had followed repeated breaches of that order; Burke had been released on 28 June 2024 after the school closed for summer holidays.
