The Supreme Court dismissed the Garda Commissioner’s appeal over the warrant to search journalist Emmet Corcoran’s home and seize his phone, reported on 22 June 2023.
The court upheld the Court of Appeal’s ruling that the warrant was invalid. It arose from a Garda investigation into violence at a house in Falsk, Strokestown, in December 2018.
Mr Justice Gerard Hogan said the case exposed gaps in safeguards for journalistic privilege and the need for an independent assessment of such claims. He also said protection of sources was integral to a free press.
The Supreme Court did not finally resolve whether Irish law or the Constitution protects journalists from being compelled to disclose sources; the issue had not been fully argued in the appeal.
