Emily Brady’s disability discrimination complaint remains undecided

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

Emily Brady’s disability discrimination complaint against Dublin restaurant 777 remained undecided when the Workplace Relations Commission hearing closed on 13 December 2023. The complaint concerns an alleged refusal to lower loud music or move her party at the restaurant on George’s Street, Dublin 2.

The restaurant denies discrimination. Its manager, Pepé Rodriguez, and waitress Christine Noguera said Brady had not told them she had a hearing impairment; Brady and her friend Pat McCarthy gave contrary evidence. Brady acknowledged that Noguera had trouble understanding English and might not have heard or understood her disclosure.

The restaurant’s solicitor, Michelle Loughnane, said Rodriguez had stated that the music was turned down at Brady’s request and that reasonable accommodation was provided. Brady and McCarthy had disputed the assertion that the music was turned down.

Adjudicator David James Murphy closed the hearing to consider his decision, which was expected to be issued to the parties in the new year.
